the ACA (Affordable Care Act):

    Federal (ACA) Requirements

  • Employers with 50 or more full-time (or full-time equivalent) employees are considered Applicable Large Employers (ALEs) under the Affordable Care Act.
  • ALEs must offer affordable minimum essential coverage (MEC) that provides minimum value to full-time employees (and their dependents), or face employer penalties if any full-time employee receives a premium tax credit for individual Marketplace coverage.
  • ALEs must report coverage information annually to the IRS (Forms 1094-C/1095-C).

    • California-Specific Requirements

  • Individual Mandate: Since January 1, 2020, California requires residents to maintain MEC (minimum essential coverage) or pay a state tax penalty. Employers are not directly penalized, but this increases employee reliance on employer-sponsored coverage.
  • Employer Reporting to FTB: ALEs must also file the same ACA health coverage reports with the Franchise Tax Board (FTB) each year, in addition to the IRS:
  • Forms must be provided to employees by March 31.
  • Reports must be filed electronically with the FTB by April 1.
